Privacy Policy

1. Scope

This Privacy Policy applies to the mobile application TrackAPP LS AndSoft (the “Application”). It explains how personal, operational and device data may be accessed, collected, used, stored, disclosed and protected when authorised users access the Application and the transport and logistics services made available through it.

TrackAPP LS AndSoft is a service owned and operated by Luís Simões. The Application is developed, maintained and published on Google Play by Mobile AndSoft on behalf of Luís Simões.

2. Data processed by the Application

Depending on the functions used and the permissions granted by the user, the Application may process:

• Account and identification data, including user identifiers, authentication tokens and information associated with the contracted service.
• Operational transport and logistics data, including journeys, routes, stops, delivery or collection events, timestamps, status updates and incidents.
• Precise or approximate device location when required for operational transport and tracking functions.
• Photographs, videos or documents deliberately selected or captured by the user for a specific operational process.
• Device and technical data, including device model, operating system version, application version, network information, push notification identifiers and technical configuration.
• Diagnostic and log information generated when an error occurs or when required to maintain the security, stability and operation of the service.
• Information intentionally submitted by the user through forms, messages or support requests.

3. Purposes of processing

The data described above may be processed to:

• Authenticate authorised users and provide the contracted transport and logistics service.
• Register, manage and verify journeys, routes, deliveries, collections and transport events.
• Provide operational tracking and location-based functions.
• Allow users to attach photographs, videos or documents to operational records.
• Send service-related notifications and operational communications.
• Detect and correct errors, prevent misuse and protect the security and integrity of the service.
• Comply with applicable legal, regulatory, contractual and audit requirements.
• Support and improve the performance and reliability of the Application.

Personal data is not sold and is not used for behavioural advertising.

4. Location and background location

The Application may access precise or approximate location to register and verify journeys, routes, stops and transport events. Location may be processed while the Application is in use. When an active transport or tracking operation requires it, and only after a prominent in-app disclosure and the relevant Android permission have been provided, location may also be processed while the Application is running in the background or is not visible on screen.

Background location is used exclusively for operational transport and tracking functions. It is not used for advertising. Users may deny or withdraw location permission through the device settings, although functions that depend on location may then be unavailable or incomplete.

5. Photos, videos and documents

The Application accesses a photograph, video or document only when the user deliberately selects or captures it for an operational process, such as documenting a delivery, collection, incident or transport event. The Application uses the Android system picker or another system-provided selection mechanism for one-time or infrequent access and does not require unrestricted access to the device’s photo or video library.

6. Push notifications and diagnostic information

The Application may process a push notification identifier and basic device information to deliver operational notifications and maintain the service. Technical logs and diagnostic information may be processed when an error occurs or when needed to investigate performance, compatibility or security incidents. This information is limited to what is reasonably necessary for those purposes.

7. Legal basis

Personal data is processed only where a valid legal basis applies. Depending on the context, this may include performance of a contract, compliance with a legal obligation, legitimate interests connected with the secure provision of transport and logistics services, or the user’s consent where consent is required by applicable law.

8. Data sharing and service providers

Personal and operational data is made available only to authorised persons and organisations that require it to provide, manage, support or audit the contracted service. This may include Luís Simões, the user’s employer or contracting organisation, authorised customers, Mobile AndSoft as application developer, infrastructure and hosting providers, notification providers, technical support providers, and public authorities when disclosure is legally required.

Service providers must process data only for the agreed purposes and under appropriate contractual, confidentiality and security obligations.

9. International transfers

If personal data is transferred outside the country or region in which it was collected, the appropriate transfer mechanisms and safeguards required by applicable data protection law will be used.

10. Data retention and deletion

Personal data is retained only for as long as necessary to provide the contracted service and meet applicable legal, regulatory, contractual, security and audit obligations. The applicable retention period depends on the type of record and the purpose for which it is processed. When data is no longer required, it is deleted, anonymised or securely archived in accordance with the applicable retention policy.

Users may request information about retention or request deletion of their personal data by contacting etica@luis-simoes.com. Requests may be subject to identity verification and to legal or contractual obligations requiring certain records to be retained.

11. Security

Luís Simões and its authorised service providers apply appropriate technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access. Access is limited to authorised persons according to operational need.

No method of electronic transmission or storage is completely secure, and absolute security cannot be guaranteed.

12. User rights and choices

Subject to applicable law, users may have the right to request access to, correction of, deletion of, restriction of or objection to the processing of their personal data, as well as data portability and withdrawal of consent. Withdrawal of consent does not affect processing carried out before withdrawal.

Camera, photo, notification and location permissions can also be managed through the Android device settings. Disabling a permission may prevent the corresponding function from operating.

Privacy requests may be sent to etica@luis-simoes.com. Users may also have the right to lodge a complaint with the competent data protection authority.

13. Children’s privacy

The Application is intended for authorised professional users of transport and logistics services and is not directed to children. The Application is not knowingly used to collect personal data from children.

14. Third-party services and external links

The Application may rely on third-party technical services or contain links to external services. Those services may process information under their own terms and privacy policies. Material service providers are required to apply appropriate privacy and security protections.

15. Changes to this Privacy Policy

This Privacy Policy may be updated when the Application, the service, processing activities or applicable legal requirements change. The updated version will be published at this URL and will show its effective date. Where required, users will be informed through the Application or another appropriate channel.
